The question comes up regularly: "My partner is 57 and I'm 49 — can we buy in a 55+ community?" The answer, under federal law, is yes — with important nuances. Here's how the age requirement actually works for couples where one person is under 55.

The HOPA Rule — Federal Law

The Housing for Older Persons Act (HOPA) permits 55+ communities to maintain age restrictions while allowing at least one occupant per unit to be 55 or older, provided that at least 80% of occupied units have at least one person 55+. This means: as long as one partner in a couple is 55 or older, the couple can legally purchase and occupy a HOPA-qualified 55+ community.

The 55+ Rule in Practice for Couples

Partner A is 58, Partner B is 47. Under HOPA, they can purchase in any qualifying 55+ community because at least one occupant (Partner A) is 55+. Partner B is legally permitted to reside in the home. The HOA cannot deny occupancy to Partner B solely on the basis of age, as long as Partner A qualifies.

Community-Specific Rules Can Be Stricter

HOPA sets the minimum federal standard. Individual HOAs can set stricter rules than HOPA requires. Some communities require both occupants to be 55+. Others allow one person at 55+ with no age floor for the second occupant. Still others require the younger partner to be at least 40 or 45.

Do not assume HOPA means automatic community-wide acceptance. Before purchasing, read the specific community's CC&Rs occupancy rules and confirm with the HOA management company in writing that the younger partner's age is compliant with the community's specific requirements. The 80% Occupancy Rule

HOPA also requires that at least 80% of the community's occupied units have at least one person 55+. This is a community-level requirement, not a unit-level requirement. In practice, established communities like Sun City Summerlin have been HOPA-qualified for decades and the 80% threshold is reliably maintained. This requirement is generally not a practical concern for buyers in well-established Las Vegas 55+ communities.

For couples where the younger partner is significantly under 55 (under 45), some communities will have stricter requirements than HOPA's minimum. The safest approach: identify the 2–3 communities of interest, request their specific age-restriction policy in writing, and confirm before spending time touring homes. What About Minor Children?

55+ communities qualifying under HOPA cannot be home to minor children as permanent occupants — only temporary visitors for limited periods (typically 30–60 days, per community rules).
