Hilton Head & Bluffton 55+ HOA Documents Guide

What to request before making an offer on any Bluffton or Hardeeville 55+ community — and what the documents actually tell you about the financial health of the community you are buying into

The Documents Every Buyer Should Request

South Carolina law requires sellers to provide an HOA disclosure package, but the required package does not always include every document a buyer needs for a thorough evaluation. Request all of the following explicitly, in writing, before removing inspection contingencies:

CC&Rs / Declaration of Covenants

Governs age restrictions, owner obligations, and POA authority. The amendment provisions are critical — understand how the community can be changed.

Reserve Fund Study (most recent)

Shows funded percentage for all major capital components. Below 70% funded on critical items means special assessment risk.

Current Year Budget

How the HOA spends money and whether current fees cover operating costs.

Past 12 Months Board Meeting Minutes

Pending issues, fee increase discussions, and infrastructure problems appear in minutes before formal notices.

Rules and Regulations

Rental restrictions, pet policies, home improvement approval processes.

Pending Special Assessments

Any approved assessments transfer to the buyer. Must be disclosed but sometimes require explicit request.

Reserve Fund Red Flags

A community with less than 70% of its reserve components fully funded is carrying deferred maintenance risk. Key questions to ask about any reserve study:

Sun City Hilton Head is a mature community with significant infrastructure — golf courses, three amenity campuses, miles of roads. Its reserve obligations are substantial and worth scrutinizing carefully.

SC's 5-Day Review Right — Use It

South Carolina gives buyers 5 business days after receiving the HOA disclosure package to review documents and cancel without penalty. This is a meaningful consumer protection. Use the full 5 days. Hire a South Carolina real estate attorney to review the CC&Rs and reserve study if you are not experienced with HOA document review — an attorney review typically costs $300–$500 and can save tens of thousands in avoided special assessments or rule violations.
