Why HOA Documents Matter More in 55+ Communities

In a standard residential community, HOA documents primarily govern aesthetics (paint colors, landscaping) and shared-space rules. In a 55+ community like Sun City Hilton Head, the HOA documents govern your entire lifestyle: which amenities you can access, how the community can change its age restrictions, what special assessments can be levied, how golf operations are funded, and how the community handles major capital projects. Reading them is not optional for serious buyers.

SC law requires sellers to provide a disclosure package including key HOA documents. But not all documents are automatically included, and knowing what to ask for is the buyer's responsibility.

Documents to Request Before Making an Offer

Declaration of Covenants (CC&Rs)

The foundational document. Establishes age restrictions (who can live in the community), all owner obligations, and what the POA can and cannot do. Read the amendment provisions carefully.

Most Recent Reserve Fund Study

The actuarial document that tells you whether the community's reserves are adequately funded for major capital replacements. Underfunded reserves mean future special assessments. This is one of the most important financial documents in any community purchase.

Current-Year Budget

How the POA spends money, what reserves are being funded, and whether current HOA fees are covering operating expenses or drawing down reserves.

Most Recent Meeting Minutes (12 months)

What the board has been discussing. Pending special assessments, major infrastructure issues, ongoing disputes, and planned fee increases are frequently discussed in board meetings before they appear in formal notices.

Rules and Regulations

Rental restrictions (can you rent your home short-term?), pet rules, vehicle rules, home improvement approval processes, and anything else that governs daily life.

All Pending Special Assessments

Any approved but not yet billed special assessments transfer to the buyer at closing. This is a direct financial obligation. Ask explicitly — it is not always disclosed proactively.

What to Look for in the Reserve Fund Study

The reserve fund study shows the funded percentage of each major capital component (roads, roofs, pool systems, mechanical equipment, etc.). A community that is less than 70% funded on critical components carries real special assessment risk. Sun City Hilton Head is a large, mature community with significant infrastructure — including golf course equipment, multiple pool systems, and three amenity campuses. The reserve study tells you how well that infrastructure is being maintained financially.

Ask for the most recent study and look for: (1) the overall funded percentage, (2) any components that are significantly underfunded, and (3) any components with replacement timelines in the next 3–5 years. These are the items most likely to generate special assessments during your early ownership years.

The Rental Restriction Question

Sun City Hilton Head restricts short-term rentals — this is common in 55+ communities. The rules govern minimum rental periods and who can occupy the home. If you are purchasing with any intention of renting the property (even occasionally, even to family members under 55), read the rental restrictions carefully before closing. The SC 5-Day Review Period

South Carolina law provides buyers with a 5-day review period after receiving the HOA disclosure package. During this window, you can cancel the contract without penalty if the documents reveal something unacceptable. This is a real consumer protection — use it. Many buyers receive the package, skim it, and waive the right without realizing what they missed.
